1 Acceptance of Terms

Welcome to Buildor. These Terms of Service ("Terms") govern your access to and use of the Buildor platform, including our website builder, e-commerce tools, business listing features, and all associated services (collectively, the "Services") provided by Buildor Platforms, Nepal.

By creating an account, accessing, or using our Services in any way, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please do not use our platform.

2 Eligibility

Buildor's Services are available to anyone with no minimum age restriction. However, by using our platform you represent and warrant that:

• If you are under the age of 13, you have obtained verified parental or guardian consent prior to use
• You have the legal capacity to enter into a binding agreement under the laws applicable in your jurisdiction
• You are not prohibited from using the Services under any applicable law
• The information you provide when registering is accurate and up to date

Buildor reserves the right to refuse access to any individual or entity at its sole discretion.

3 Account Responsibilities

When you create an account on Buildor, you are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account, whether authorised by you or not
• Notifying us immediately at [email protected] if you suspect unauthorised access
• Keeping your contact information (email, phone number) accurate and up to date
• Ensuring that any team members you grant account access to also comply with these Terms

Buildor will not be liable for any loss or damage arising from your failure to maintain account security.

4 Permitted Use

You may use Buildor's Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform to publish or distribute illegal, defamatory, hateful, or fraudulent content
• List counterfeit, prohibited, or illegal products or services on your store
• Attempt to gain unauthorised access to our systems, servers, or another user's account
• Use automated bots, scrapers, or scripts to extract data from the platform
• Engage in spam, phishing, or any form of deceptive marketing through our tools
• Resell or sublicense Buildor's Services without express written permission
• Violate any applicable local, national, or international law or regulation

5 Subscription & Payments

Buildor offers paid subscription plans (Basic, Pro, and Enterprise) billed on a monthly basis. By subscribing to a paid plan, you agree to the following:

• Subscription fees are billed in advance at the start of each billing cycle
• Your subscription automatically renews unless cancelled before the renewal date
• You are responsible for all applicable taxes in your jurisdiction
• Failure to pay may result in suspension or downgrade of your account

We accept the following payment methods:

• Credit / Debit Card (Visa, Mastercard, and others)
• PayPal
• eSewa / Khalti (for Nepal-based users)
• Bank Transfer
• Any other payment method made available at the time of checkout

Buildor reserves the right to change subscription pricing with at least 30 days' advance notice to existing subscribers.

6 Refund Policy

Buildor evaluates refund requests on a case-by-case basis. There is no automatic right to a refund. Refunds may be considered under the following circumstances:

• A verified technical issue caused by Buildor that prevented you from accessing core features
• Duplicate or erroneous charges due to a billing error on our part
• Exceptional circumstances reviewed at our sole discretion

Refunds will generally not be issued for change of mind, partial use of a billing period, or feature dissatisfaction that was not reported prior to renewal.

7 Your Content

You retain full ownership of all content you create, upload, or publish on Buildor — including website content, product listings, images, business information, and customer data ("Your Content").

By using the platform, you grant Buildor a limited, non-exclusive, royalty-free licence to host, store, display, and deliver Your Content solely for the purpose of providing the Services to you.

You are solely responsible for ensuring that Your Content:

• Does not infringe any third-party intellectual property rights
• Complies with all applicable laws and regulations
• Is accurate, truthful, and not misleading to customers or visitors
• Does not contain malware, viruses, or harmful code of any kind

Buildor reserves the right to remove any content that violates these Terms without prior notice.

8 E-Commerce Features

Buildor provides e-commerce tools including product listing, order management, inventory tracking, and customer management. When using these features, you agree that:

• You are solely responsible for the accuracy of product listings, pricing, and descriptions
• You are responsible for fulfilling orders placed by your customers on time
• You will handle your customers' personal data in accordance with applicable privacy laws
• You will not list prohibited, counterfeit, hazardous, or illegal products
• All transactions between you and your customers are your sole responsibility
• You are responsible for collecting and remitting any applicable taxes on your sales

9 Intellectual Property

All elements of the Buildor platform — including but not limited to the software, codebase, design, templates, UI components, branding, logos, and documentation — are the exclusive intellectual property of Buildor Platforms and are protected under applicable intellectual property laws.

You may not:

• Copy, reproduce, or reverse-engineer any part of the platform
• Use the Buildor name, logo, or branding without prior written permission
• Claim ownership over any Buildor-provided templates or design elements
• Remove any copyright or proprietary notices from any portion of the Services

Any feedback, suggestions, or ideas you provide to Buildor may be used by us to improve the platform without any obligation to compensate you.

10 Termination

You may terminate your account at any time by contacting us or through your account settings. Upon termination:

• Your access to the platform and all associated data will be deactivated
• Your published website(s) and store will be taken offline
• We may retain certain data as required by law for a limited period

Buildor reserves the right to suspend or permanently terminate your account at any time, without notice, if we determine you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users.

Termination does not relieve you of any outstanding payment obligations incurred prior to the termination date.

11 Limitation of Liability

To the maximum extent permitted by applicable law, Buildor Platforms shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, customers, or business opportunities arising from use of the platform
• Data loss resulting from user error, third-party interference, or force majeure events
• Service interruptions due to scheduled maintenance, infrastructure issues, or events beyond our control
• Actions or omissions of your customers, including disputes arising from your e-commerce transactions

Buildor's total liability for any claim arising out of or related to the Services shall not exceed the total amount paid by you to Buildor in the three (3) months preceding the claim.

12 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles.

Any dispute, controversy, or claim arising from or relating to these Terms or the use of the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, the dispute shall be submitted to the competent courts of Nepal.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable in full.
